This happens because, under Florida law, a surviving spouse is entitled to a “legal inheritance” of 30% of the deceased spouse`s estate — regardless of the terms of the deceased spouse`s estate plan or the surviving spouse`s economic needs. While there are several ways to regulate matrimonial inheritance law, the best option is often for spouses to legally adjust or waive all matrimonial inheritance rights through a marriage or post-marriage contract. In such a case, both partners are then free to design their estate plans at will and without restrictions by the Florida Estate Act. In addition, guardianship often occurs because a person simply does not have a sufficient and coordinated network of family members and professional counselors who can fill gaps in the person`s life caused by aging or illness.
